Hello Every One.



This is Satya Prakash.



I got a doubt regarding leaves. Previously we used to encash earned leaves @ gross salary. Maternity leave we are giving 3 Months (12 Weeks) leave and used to pay @ full salary.



Considering the recession I have made following changes. Please suggest me weather they are lawful or not.



1. We are giving 12 Earned leaves and these leaves will be en cashed @ Basic pay. If any one is not using theirs leaves.

2. Maternity leave we are giving 3 Months (12 Weeks) leave and for this 3 months they will be paid @ 50% of their monthly salary.



Please suggest me whether these changes are lawful or not. Please forward me the government policy on those.



Please give me your valuable suggestions.

Hi Satya

As far as my knowledge goes-

Earned leave - (As declared under Factories Act 1948) - is entitled with full salary exclusive of bonus or overtime. It has to be paid 1day @ every 20 days of work for adults and 1 day@ every 15 day for child. For any more clarifications refer Factories Act 1948.

Maternity leave- ( As under Maternity Benefit act- 1961) - it is mandatory that we provide them full months wages exculsive of overtime. Anyway please refer the act. that would make things clear to you.

As far as my knowledge concernes EL calculate on Basic Wages, and regarding Maternity leave , it depneds on the company policy
