Make sure your contractors submit all the returs properly.
It happend in ............., one employee took his wife to ESI hospital for emergency treatment he has been informed that his name is not in the list and asked to go to the Branch office to verify what happend. When he reached the B.O the Branch Manger looked into the matter and understood the consultant has not submitted the returns for the last 2 years.
So ask your contractors to sumbit the copy of returns submitted.

Ours is a Company engaged in taking Interior Contract's. We are reqistered under ESI & PFActs in Delhi. We engage Contractors for say Carpentry, Plumbing, Electrical etc. work and they are generally unregistered. I want to firstly what is our liability with regards to ESI / PF deposit on labour charges paid to these Contractors. Secondly if we are liable to deposit ESI / PF on labour charges paid, what is the percentage and where have we to deposit that since we are registered only in Delhi.

PF /ESI deductions depends upon total manpower engaged at work side at any time and remunerations workmen getting. please check.. applicability.
As you are from principal employer side, it comes under your liability. for that
Either you engage those contractor who have esi/ pf code already allotted or you arrange to apply and obtain documentation for contractor PF/ esi code.
solution:
1) The PF & ESI have to be paid by the contractor, but you have to keep one copy of the challans and the returns submitted by them and other relevant records pertaining to wgs payment, attendance etc to submit to pf authorities on their inspection.
2) You deposit their pf/ esi and recover from contractor bill / workers salary. keep required documents as stated in point 1.

Employer side : 8.33% (pension fund) + 3.67% (prov. fund)= 12%
: + some 2% as admn. ch. insu., other
Employee side : 12% (Provident fund)
ESI
Employer side : 4.75%
Employee side : 1.75%
