Its a really good observation. I went through the same channel when I was formulating referral policy for our organization.

The following are the suggestions to make referral an effective tool :

i) Post referral, the CV should follow the same recruitment channel & not skip any channel. Also, the person reffered should not mdisclose the refferee's name at any process of selection. (Only HR knows it that its a referral).

ii) Also, one can't refer his/her relative as referral.

iii) With respect to the commitment level, the referee will have to repay the referral bonus in case the reffered employee leaves before completing 1 year with organization.

Hi Rashmi,

There are coupe of factors involved though IT companies fall under Shops & establishment act, the following act is attached for your ref.

i) Kindly refer the contract as IT orgn has to comply by the working hrs agreed between IT firm & client (specific to employees working in that project).

ii) One has to comply by industry practice. e.g.- In hotel industry 12 hrs shift is common, however in IT firm you can't ask an employee to work for more than 8-9 hrs daily.

You can get them so much work that they have to work more than 8-9 hrs its not a problem. You can't be questioned, legally you can't keep your timings more than 8-9 hrs.
